$1.5 Million Case Result in Hostile Workplace Lawsuit
Our attorneys at Montoya, Lucero & Pastor, P.A. secured a $1.5 million case result on behalf of one of our clients after filing a hostile workplace lawsuit against the city of Phoenix. The case went to trial for six days in the U.S. District Court in Phoenix, where a jury ruled in favor of our client.
Case Details
Our client has worked in the Phoenix Police Department since 1994, serving as a sergeant. In 2015, we filed a lawsuit after our client was told by his supervisor that he needed to “get rid” of a female officer who informed our client that another sergeant had touched her between her legs at an off-duty event. Our client told his boss he can’t “say that, it’s retaliation.”
Fighting for Justice
Speaking to the Arizona Republic about the troubling issue our client was presented with by his employer, attorney Stephen Montoya said, “These cases, taking on the police department, is really, really hard. It’s absolutely a big victory. A big and worthwhile victory.”
However, attorney Montoya says the victory comes at the expense of taxpayers, “It’s the public's money and they (Phoenix) get away with it. People usually don’t find out about it, so they (Phoenix) get away it.”
Although the Phoenix Police Department hasn’t said if any officers involved in the case were disciplined, they did release the following statement:
“Neither the City of Phoenix, nor the Phoenix Police Department will tolerate sexual harassment in the workplace. We support a culture of respect and positive behavior and encourage the reporting of inappropriate behavior at any level.”
